These Terms of Service (“Terms”) govern access to and use of the website located at deedhero.com and any related websites, forms, portals, software, services, content, functionality, text messaging programs, email communications, telephone outreach, and related offerings provided by Deed Hero (“Deed Hero,” “Company,” “we,” “us,” or “our”).

By accessing or using the Services, submitting information through our website, checking a consent box, signing up for text messages, responding to a campaign, communicating with us by email or phone, or otherwise interacting with the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Scope of Services

Deed Hero provides information, tools, communications, and related services concerning the resolution of complex property ownership challenges — including inheritance disputes, title problems, probate, delinquent taxes, foreclosure avoidance, liens, vacant properties, squatter situations, and related real estate matters — serving families, investors, attorneys, and communities throughout Texas and beyond. Nothing on the Services constitutes legal, financial, tax, real estate, insurance, lending, or other regulated professional advice unless expressly stated in a separate written agreement.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, to the fullest extent permitted by law.

3. No Guarantee of Results

Any testimonials, examples, projections, or case studies are illustrative only and do not guarantee future outcomes. Actual results depend on many factors outside our control.

4. User Information and Submissions

When you submit a form, schedule a call, request information, subscribe to communications, or otherwise provide information to us, you agree that:

By opting in to receive text messages from Deed Hero, you agree to receive recurring or one-time SMS or MMS messages at the number provided. These may include conversational messages, appointment reminders, service notifications, follow-ups, and, if you have separately consented where required, promotional messages.

If you provide a telephone number, you consent to receive calls from us regarding your inquiry, relationship with us, transactions, service updates, scheduling, support, and, where permitted and properly consented to, marketing. Where required by applicable law, we will obtain the level of consent necessary before placing autodialed, prerecorded, or artificial-voice calls or texts.

You agree that we may record calls for quality assurance, training, compliance, and recordkeeping purposes, subject to applicable law.

C. Email Communications

By providing your email address, you consent to receive emails from us related to your requests, account, transactions, operational updates, and, where permitted, marketing and promotional content. You may unsubscribe from marketing emails at any time by using the unsubscribe link in the message or contacting us at david@deedhero.com. Even if you opt out of marketing emails, we may still send you transactional or relationship messages where permitted by law.

D. Compliance and User Responsibilities

You agree not to provide a phone number or email address that you do not own or have authority to use. You agree to notify us promptly if your contact information changes.

We reserve the right to maintain records of consent, opt-ins, opt-outs, communication preferences, and related logs for compliance, dispute resolution, and enforcement purposes.

If Deed Hero offers paid services, products, subscriptions, or deposits, additional terms may apply and will be presented at the time of purchase or in a separate agreement. Unless otherwise stated, fees are non-refundable except as required by law.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DEED HERO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICES WILL BE COMPLETE, CURRENT, OR ACCURATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEED HERO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, DEED HERO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DEED HERO IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Deed Hero and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of the Services, your violation of these Terms, your violation of applicable law, or your infringement of any rights of another person or entity.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, applicable law, or created risk or potential liability for Deed Hero. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and communications records.

Your use of the Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

15. Geographic Restrictions

The Services are controlled and operated from the United States unless otherwise stated. We make no representation that the Services are lawful or appropriate in every jurisdiction. You are responsible for compliance with local laws applicable to your use of the Services.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services will first be addressed through good-faith informal efforts by contacting david@deedhero.com.

If a dispute cannot be resolved informally, it will be resolved exclusively in the state or federal courts located in El Paso, Texas, and each party consents to the personal jurisdiction and venue of those courts, unless a separate written agreement provides otherwise.

Optional arbitration clause: If you prefer arbitration instead of court litigation, consult counsel before adding that language, since consumer arbitration drafting should be carefully tailored.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, except to the extent superseded by applicable federal law.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a revised “Last Updated” date. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
