Deed Hero provides information, tools, communications, and related services concerning the resolution of complex property ownership challenges — including inheritance disputes, title problems, probate, delinquent taxes, foreclosure avoidance, liens, vacant properties, squatter situations, and related real estate matters — serving families, investors, attorneys, and communities throughout Texas and beyond. Nothing on the Services constitutes legal, financial, tax, real estate, insurance, lending, or other regulated professional advice unless expressly stated in a separate written agreement.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, to the fullest extent permitted by law.

Any testimonials, examples, projections, or case studies are illustrative only and do not guarantee future outcomes. Actual results depend on many factors outside our control.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DEED HERO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICES WILL BE COMPLETE, CURRENT, OR ACCURATE.

TO THE FULLEST EXTENT PERMITTED BY LAW, DEED HERO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, DEED HERO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DEED HERO IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Deed Hero and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of the Services, your violation of these Terms, your violation of applicable law, or your infringement of any rights of another person or entity.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, applicable law, or created risk or potential liability for Deed Hero. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and communications records.

Your use of the Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

The Services are controlled and operated from the United States unless otherwise stated. We make no representation that the Services are lawful or appropriate in every jurisdiction. You are responsible for compliance with local laws applicable to your use of the Services.

Any dispute arising out of or relating to these Terms or the Services will first be addressed through good-faith informal efforts by contacting david@deedhero.com.

If a dispute cannot be resolved informally, it will be resolved exclusively in the state or federal courts located in El Paso, Texas, and each party consents to the personal jurisdiction and venue of those courts, unless a separate written agreement provides otherwise.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, except to the extent superseded by applicable federal law.
